  • This is an individual participation hackathon, you have participate individually.

  • It's an online hackathon, you can participate from anywhere.

  • There are 1 themes of the hackathon, you must submit a hack that is in one of these themes.

  • Once the hackathon starts, you will get an option to submit your hack, you can submit as many times as you want, the last hack will be considered as the final submission.

  • You are expected to come up with new and innovative ideas, any idea that has been copied from somewhere will be disqualified.

  • Your hack must be developed entirely during the Hackathon duration. You may use open source libraries and other freely available systems / services such as Google Maps, Facebook Connect, Twitter feeds etc.

  • The intellectual property of your code belongs only to your team.

  • By participating in the hackathon, you agree to the terms and conditions of HackerEarth.

These are the official rules (the “Rules”) for the DataStax Holiday Hackathon (“Hackathon”) that is being conducted by HackerEarth Inc. (“HackerEarth”) on behalf of DataStax, Inc, a Delaware, USA corporation.(“DataStax” or “Hackathon Organizer”). In order to enter the Hackathon, participant (“You” or “Participant”) must agree to the Rules. Your participation in the Hackathon will constitute your acceptance of these rules. By accepting these rules, you are entering into a binding agreement with DataStax, Inc. The Hackathon is sponsored by DataStax and hosted by HackerEarth Inc., a Company incorporated in the state of Delaware, USA. Additionally, you must read and provide your consent to HackerEarth’s Terms of Service and Privacy Policy, as well as DataStax Astra’s Terms of Service and Privacy Policy. You may not submit an submission to the Hackathon and are not eligible to receive the prizes described in these Rules unless You agree to these Rules. These Rules form a binding legal agreement between You, Hackathon Organizer and HackerEarth with respect to the Hackathon.

  7. Participant: Each individual who has registered for the DataStax Holiday Hackathon including the members of teams that are formed for the hackathon
  8. Privacy Policy: Legal document that describes how HackerEarth gathers and manages participant data
  9. Submission: Solutions that you submit for the problem statement of the DataStax Holiday Hackathon
  10. Team: Group of participants who will participate collectively in the DataStax Holiday Hackathon
  11. Terms of Service: Rules that you must follow while using HackerEarth’s service
  12. www.hackerearth.com: HackerEarth’s platform on which you must sign up to be able to participate in the DataStax Holiday Hackathon
  13. www.astra.datastax.com: DataStax’s platform on which you might sign up to be able to access DataStax Astra which is used to participate in the DataStax Holiday Hackathon

 

 

1. Hackathon Period

The Hackathon takes place in one phase. The Submission Phase begins in December ---, 2020 and ends in January ---, 2021, (altogether the “Hackathon Period”). Hackathon deadlines are subject to change and additional deadlines may be introduced during the hackathon. Any additional or altered deadlines, not already described in these rules, will be updated on the Hackathon website for the Participant’s information and the Participant will be bound by such changes. The Participant will monitor the Hackathon website regularly to get information about new or updated deadlines. Neither HackerEarth nor the Hackathon Organizer is responsible for any Participant's failure to do so.

2. How to Enter

To enter the Hackathon, participants must register using a single, unique HackerEarth account registered at http://www.hackerearth.com. Participating in the Hackathon using more than one HackerEarth account per Participant or otherwise using multiple accounts, identities, or devices in an attempt to circumvent the rules per is a breach of these rules and the HackerEarth or Hackathon Organizer reserves the right to disqualify any Participant or team that includes the Participant who has breached these rules.

3. Eligibility

This Contest is open to developers, who are at least eighteen (18) years of age or older. The contest is void where prohibited by law. Employees, interns, contractors, and official office-holders of HackerEarth Inc. and its affiliated companies, subsidiaries and any of their agents, advertising, promotional and other agencies, and the immediate families (parents, siblings, children and spouse) and persons living in the same household (whether related or not) of such employees/directors/officers may participate in the hackathon but will not be eligible to win prizes. The Hackathon is not open to employees, interns, contractors, and official office-holders of DataStax, Inc. and it affiliated companies, subsidiaries and any of their agents, advertising, promotional and other agencies, and the immediate families (parents, siblings, children and spouse) and persons living in the same household (whether related or not) of such employees/directors/officers.

Participants may enter as individual participants or as part of a team. The maximum number of Participants on a team is four (4) Participants. If a team has more than 4 participants, it will be disqualified by the Hackathon Organizer.

Participating in the Hackathon using multiple HackerEarth accounts is a violation of the Hackathon rules and will result in the disqualification of the team and/or the Participant by the Hackathon Organizer. Upon disqualification, each Participant’s access to the HackerEarth Community will be terminated for an indefinite period. Using any unfair means (e.g., having someone else log in using your credentials and submit a project on your behalf) during the Hackathon will result in Your disqualification from the Hackathon and from any other hackathons that may be affected by your actions. You are not allowed to share your submission, code, or data with anybody who does not belong to your team.

 

 

4. How to Win and Prizes

As part of the Hackathon, Participants are required to submit their material on the platform made available for this purpose. Submissions may include ideas, prototypes, and applications. All submissions that the Participants make must be original and unique. All submissions must be made on or before the deadline and must meet all the guidelines defined for this purpose. All decisions by Hackathon Organizer are final and binding on all participants.

Winners will be notified at the latest 15 days from the end of the Hackathon Period of the selection of Winner(s). The award is per submission, whether an individual or team. Hackathon Organizer and HackerEarth shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 5 business days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as may be required, the prize may be forfeited and an alternate Winner selected. Prizes may not be resold and may not be transferred without written consent of Hackathon Organizer.

Prizes are subject to change at any time and at the discretion of Hackathon Organizer and HackerEarth. Actual/appraised value may differ at the time of prize award. No prize substitution shall be permitted except at Hackathon Organizers or HackerEarth’s sole discretion. All Prizes are awarded “AS IS'' and WITHOUT WARRANTY OF ANY KIND, express or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). All Prizes may not be awarded if there are not a sufficient number of eligible entries received. Acceptance, participation in and/or use of the Prizes are at the winners’ sole risk and Hackathon Organizer and HackerEarth are not responsible for damages whatsoever, including special, indirect, or consequential damages, arising out of or in connection with the use and/or misuse of any of the Prizes. HackerEarth or its employees will communicate with the Winner(s) directly and obtain the necessary information to facilitate its distribution of the prize.

5. Taxes

TAXES: AWARDS OF PRIZES TO POTENTIAL WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO HACKEREARTH ALL DOCUMENTATION REQUESTED BY HACKATHON ORGANIZER OR HACKEREARTH TO PERMIT IT TO COMPLY WITH ALL APPLICABLE STATE, FEDERAL AND LOCAL TAX REPORTING ALL PRIZES WILL BE NET OF ANY TAXES HACKATHON ORGANIZER OR HACKEREARTH IS REQUIRED BY LAW TO WITHHOLD. TO THE EXTENT PERMITTED BY LAW, ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. In order to receive a prize, potential winners must submit tax documentation requested by Hackathon Organizer or HackerEarth or as otherwise required by applicable law, to HackerEarth or a representative HackerEarth or the relevant tax authority, all as determined by applicable law. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and HackerEarth may, in its sole discretion, select an alternate potential winner.

6. Intellectual Property Rights

Participant agrees and understands that all Submissions shall be distributed for the purposes of evaluating Submissions and administering and marketing the Hackathon.

Any data, datasets, resources including any prototype, executable code, or a sandbox instance is owned by either Hackathon Organizer or HackerEarth. The relevant data and resources will be provided to the participants either by HackerEarth or by the Hackathon Organizer. Participant may only use such data and resources for the purposes of creating its submission and may only access, read, learn, analyze, and modify the data and resources provided only on the platform and not when offline. The Participant will use suitable measures to prevent unauthorized persons from gaining access, transmitting, duplicating, publishing, and distributing the data and resources. Each Participant also agrees to notify HackerEarth in the event of any possible unauthorized transmission or access to the data and resources and agrees to work with HackerEarth and/or the Hackathon Organizer to remedy any unauthorized transmission/access.

7. Privacy

HackerEarth will collect your personal information as specified by the Hackathon Organizer. This data includes but is not limited to the following:

○ Email address

○ Display name

○ User profile URL

○ Information contained in your user profile

○ Any other information collected during registration for the Hackathon

○ All the submissions made during the hackathon including any personally identifiable information (e.g. passport number, etc.) that the submissions may contain.

You agree that personal data submitted to HackerEarth, including name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by Hackathon Organizer and its affiliates for the purposes of conducting and administering the Hackathon or for promotional or other purposes. By entering the Hackathon, You agree to the transmission, processing, disclosing and storage of this personal data by HackerEarth and Hackathon Organizer and its affiliates. All personal information that is collected from You is subject to Hackathon Organizer’s Privacy Policy, located at: http://www.datastax.com/privacy. You have the right to access, review, rectify or cancel any personal data held by Hackathon Organizer in connection with the Hackathon by writing to Hackathon Organizer at the following address: Privacy Matters, c/o DataStax, Inc. 3975 Freedom Circle Santa Clara, CA 95054. If You do not provide the data required at submission, your submission may be ineligible.

8. Publicity

By entering the Contest, You agree to participate in any media or promotional activity resulting from the Contest as reasonably requested by Hackathon Organizer at Hackathon Organizer’s expense and agree and consent to use of their name and/or likeness by Hackathon Organizer. Hackathon Organizer will contact You in advance of any Hackathon Organizer-sponsored media request for interviews. The Entries may also be used for press and media purposes and You agree to waive any rights and not assert any intellectual property rights that Participant has or may have in the submission. Hackathon Organizer reserves the right to publish the name and likeness of You on the Hackathon site or through other media for publicity purposes. In addition You understand and agree that Hackathon Organizer and its affiliates, subsidiaries, licensees and assigns shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your submission, name, portrait, picture, voice, likeness, image, statements about the Hackathon, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent.

9. Technical Problems

Hackathon Organizer is not responsible for any malfunction of the entire Hackathon website or any associated site or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed Entries or votes due to communication or system errors of any kind, traffic congestion on the Internet or at the Hackathon site, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit Your ability to participate in the Hackathon.

10. Rules and Conduct

All federal, state and local laws and regulations apply. Hackathon Organizer reserves the right at its sole discretion to disqualify any individual suspected of tampering with the submission process or the operation of the Hackathon; or to be acting in any manner deemed by Hackathon Organizer to be in violation of the Rules; or to be acting in any manner deemed by Hackathon Organizer to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person.

11. Right to Cancel or Modify

If for any reason the Hackathon is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Hackathon, Hackathon Organizer reserves the right at its sole discretion to cancel, terminate, modify or suspend the Hackathon. Hackathon Organizer further reserves the right to disqualify any Participant who tampers with the submission process or any other part of the Hackathon. Any attempt by You to deliberately damage any web site or undermine the legitimate operation of the Hackathon is a violation of criminal and civil laws and should such an attempt be made, Hackathon Organizer reserves the right to seek damages from You to the fullest extent of the applicable law.

12. Warranty and Indemnity

You warrant that your submission is your own original work and, as such, you are the sole and exclusive owner and rights holder of the submitted submission and that you have the right to submit the submission in the Hackathon and grant all required licenses. You agree not to submit any submission that: (a) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (b) contains malicious code, potentially harmful programs such as viruses, time bombs, cancelbots, worms, trojan horses, etc.; (c) contains any self-help code or other disabling code; (d) contains previously published projects and prizes or awards that were won for the same; or (e) otherwise violates applicable state, federal, or local law. To the maximum extent permitted by law, You indemnify and agree to keep indemnified Hackathon Organizer at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of You and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, You agree to defend, indemnify and hold harmless Hackathon Organizer from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from: (i) any submission or other material uploaded or otherwise provided You that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy; (ii) any misrepresentation made by You in connection with the Hackathon; (iii) any non-compliance by You with these Rules; (iv) claims brought by persons or entities other than the parties to these Rules arising from or related to Your involvement with the Hackathon; (v) acceptance, possession, misuse or use of any prize or participation in any Hackathon-related activity or participation in the Hackathon; (vi) any malfunction or other problem in relation to the submission and participation in the Hackathon by You; (vii) any error in the collection, processing, or retention of submission or voting information in relation to the submission and participation in the Hackathon by You and in the voting process by consumers; or (viii) any typographical or other error in the printing, offering or announcement of any prize or winners in relation to the submission and participation in the Hackathon by You.

13. Limitation of Liability

By entering, You agree to release and hold harmless Hackathon Organizer and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Hackathon and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the submission process or the Hackathon; (v) electronic or human error in the administration of the Contest or the processing of entries.

14. Disputes

THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Hackathon, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Hackathon, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Your actual out-of-pocket expenses (i.e. costs associated with entering this Hackathon). You further waive all rights to have damages multiplied or increased. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Hackathon are hereby excluded, and You expressly waive any and all such rights.
